THESE TERMS OF SERVICE (the "Agreement") GOVERN YOUR ACCESS TO AND USE OF THE BUTTER LAUNCHER HYTALE SERVICE (the "Service") PROVIDED BY BUTTER LAUNCHER ("We", "Us", or "Our"). BY ACCESSING THE SERVICE, DOWNLOADING THE SOFTWARE, OR USING OUR WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS.

IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICE.

1. The Service
1.1. Service Description. Butter Launcher is an independent, open-source Hytale launcher service available at no cost. Any content users post, upload, or share through the Service is considered a "User Submission." 1.2. Relationship to Hypixel Studios. This Service is an independent project and is not affiliated with Hypixel Studios or Hytale, and does not represent them in any capacity. 1.3. No Fee. Butter Launcher does not charge any fee for the use or redistribution of the Service.

2. Liability
2.1. User Responsibility. Use of the Service is at the user's own risk. While we strive for the highest safety standards in our software, we cannot guarantee the safety of additional modifications ("mods") or third-party content downloaded by users. Users are solely responsible for any damage to their computer system or loss of data resulting from such use.

3. User Obligations
3.1. Compliance with Laws. Users shall comply with all local, state, national, and international laws applicable to their use of the Service. 3.2. Prohibited Activities. Users shall not engage in illegal activities, including but not limited to hacking, phishing, or the distribution of malicious software via our community channels or Service.

4. Intellectual Property
4.1. Ownership. The Service and its original content (excluding Hytale assets) are owned by Butter Launcher. 4.2. User Submissions. Users retain ownership of their submissions but grant Butter Launcher a worldwide, royalty-free license to use, reproduce, and display such content in connection with the Service.

5. Third-Party Advertisements (AdSense)
5.1. Advertising. The Service may display advertisements provided by Google AdSense and other third-party vendors. By using the Service, you acknowledge that these ads are necessary to support the hosting and development of the project. We are not responsible for the content of these external advertisements.

6. Privacy
6.1. Personal Information. Our use of personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

7. Termination
7.1. Right to Terminate. We reserve the right to terminate a user's access to the Service at any time, for any reason, without notice. 7.2. Service Changes. Access to Hytale versions (online or offline) is subject to change based on legal regulations or changes in our relationship with third parties.

8. Disclaimer of Warranties
8.1. The Service is provided "as is" and "as available," without any warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.

9. Limitation of Liability
9.1. In no event will Butter Launcher be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the Service.
